Acceptable Use Policy

This Acceptable Use Policy (the "Policy") explains what you may and may not do with LarkTide API. LarkTide API is operated by LarkTide Technologies LLC, a Wyoming limited liability company ("LarkTide", "we", "us"). This Policy is part of, and enforceable under, our Terms.
In short: do not use LarkTide to harm people, break the law, deceive others, or abuse the platform. Follow the usage policy of every model provider whose model you use. If you break these rules, we may suspend or terminate your access.

1. Scope
This Policy applies to all use of LarkTide API and the related services we provide, including the API, the console, API keys, and our website (together, the "Service"), as each becomes available during the invite-only beta and afterward. It covers what you send to the Service (prompts and other inputs), what the Service returns (outputs), and how you use, publish, deploy, or act on those outputs.
It applies to everyone who uses the Service under your account, including your employees, contractors, and anyone who uses your API keys, and to the end users of any product or service you build on the Service.
You are responsible for all use of your account and API keys and for the use of the Service through applications you build. You must:
- bind your end users to rules at least as protective as this Policy;
- take reasonable steps to prevent violations by your end users and to stop them once you know of them; and
- tell us promptly, at support@larktide.com, if you learn of a violation of this Policy, and at security@larktide.com, if you learn of a compromised API key.
The Service is for business and professional use by adults aged 18 or older. It is not offered for personal or consumer use. Model outputs can be inaccurate or incomplete. You are responsible for reviewing outputs before you rely on them or share them.

2. Prohibited uses
You may not use the Service, or allow anyone else to use it, for any of the purposes below. These rules apply to inputs, outputs, and any content or system you build with them.
Discussing, researching, analyzing, teaching about, or reporting on a sensitive topic is not itself prohibited. Content that gives real operational help toward a harm listed below, or that is designed to carry it out, is prohibited. The child safety and non-consensual intimate imagery rules have no exceptions.
Illegal activity
- Violating any law or regulation that applies to you, to us, or to the use in question, or helping others do so.
- Infringing or misappropriating another person's intellectual property rights or trade secrets.
- Violating export control or sanctions laws, or facilitating money laundering, human trafficking, or trade in illegal drugs, weapons, or other illegal goods or services.
Child sexual abuse material and sexual content involving minors
- Creating, requesting, describing, uploading, or distributing child sexual abuse material (CSAM), or any sexual or sexualized content involving a person under 18, whether the content is real, fictional, or AI-generated.
- Grooming, sexually soliciting, or exploiting minors, or producing material that supports any of these acts.
We have zero tolerance for these uses. We will terminate access, and we will report apparent violations to the appropriate authorities where the law requires, as described in the Enforcement section.
Non-consensual intimate imagery
- Creating or distributing intimate or sexually explicit depictions of a real person without that person's consent, including AI-generated or manipulated ("deepfake") content.
- Sextortion, "revenge" content, or threatening to create or share such material.
Violent extremism
- Producing propaganda, recruitment material, fundraising content, or operational planning for terrorism, violent extremist groups, or violent attacks.
- Praising or inciting mass-casualty violence, or planning or facilitating violence against people or critical infrastructure.
Weapons of mass destruction
- Providing meaningful assistance in designing, producing, acquiring, stockpiling, or using chemical, biological, radiological, or nuclear weapons, or other weapons capable of mass casualties, including synthesis routes, weaponization, delivery, or evasion of controls on required materials.
Malware and cyberattacks
- Creating, improving, or deploying malware, ransomware, spyware, botnets, or other malicious code.
- Attacking or gaining unauthorized access to systems, networks, accounts, or data that you do not own and are not authorized to test, including denial-of-service attacks, credential stuffing, and exploitation of vulnerabilities.
- Building tools to steal credentials or data, or to evade detection for malicious purposes.
Defensive security work on systems you own or are authorized to test is not prohibited.
Fraud, spam, phishing, and impersonation
- Running scams, phishing, or other fraud, including fake reviews, deceptive marketing, pyramid or Ponzi schemes, and forged or fraudulent documents or identities.
- Sending or generating bulk unsolicited messages (spam), or content designed to evade spam or abuse filters.
- Impersonating a person, organization, or government body, or falsely claiming affiliation with one (including LarkTide or a model provider), in a way likely to deceive.
Harassment and hate
- Harassing, stalking, bullying, threatening, or intimidating individuals or groups.
- Promoting hatred of, dehumanizing, or inciting violence or discrimination against people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age, serious illness, or another protected characteristic.
Self-harm
- Encouraging, instructing, or glamorizing suicide, self-harm, or eating disorders.
Supportive, educational, clinical, and crisis-support content is not prohibited.
Privacy violations
- Unlawful surveillance, tracking, or monitoring of individuals, including covert monitoring of communications or location.
- Collecting, compiling, inferring, or exposing personal information in violation of law, including doxxing.
- Collecting, using, or disclosing personal information about children in violation of applicable law, including children's online privacy laws.
- Biometric identification or categorization of individuals, such as facial recognition or voiceprint matching, without a lawful basis and any legally required consent.
- Sending personal information through the Service that you have no right to share with us and with the model provider you select.
Deceptive election or political manipulation
- Spreading false information about voting procedures, eligibility, dates, or locations, or intimidating or suppressing voters.
- Impersonating candidates, officials, or election authorities, or presenting fabricated statements or synthetic media of real political figures as genuine.
- Running coordinated inauthentic campaigns or large-scale automated persuasion that conceals who is behind it.
Transparent, lawful political speech, advocacy, and campaigning are not prohibited.
High-risk automated decisions without human review
- Using outputs as the sole basis for decisions that have legal or similarly significant effects on a person, such as decisions about employment, education, credit or lending, housing, insurance, health care, government benefits, immigration, or law enforcement and criminal justice.
If you use the Service to support decisions like these, a qualified person must meaningfully review each output and be able to override it. You are also responsible for meeting any notice, explanation, and appeal requirements that apply to automated decision-making.
Extracting model weights or non-public information
- Using the Service to extract, reconstruct, or reverse-engineer the non-public weights, parameters, or system instructions of any model, or non-public parts of the Service such as its source code or infrastructure.
This rule applies to your use of the Service. It does not restrict what you may lawfully do, under the applicable license, with model weights that a provider has published.
Circumventing safety measures
- Bypassing, disabling, or interfering with any safety systems, content filters, moderation, or access controls that we or a model provider may apply, including by using jailbreak prompts or obfuscation to obtain content that this Policy or the provider's policy prohibits.
3. Model provider policies
The models available through the Service are developed and served by third-party providers. When you send a request to a model, you are using that provider's model in addition to using the Service, and you must comply with the provider's usage policy for that model as well as this Policy.

- Where this Policy and a provider's policy differ, follow the stricter rule.
- Provider policies are set and changed by the providers, not by us. You are responsible for reading and following the current version for each model you use.
- A provider may refuse or block requests and may restrict access for violations of its policy. We may suspend or terminate your access if a provider requires it, or if your use puts our access to a provider at risk.
- Content you send is processed by the provider of the model you select. See our Privacy Policy for how that works.
4. Platform integrity
API keys and access
- Keep your API keys confidential. Do not publish them, commit them to public repositories, or embed them in code that is distributed to others.
- Do not share your keys or accounts with other organizations, and do not sell, resell, sublicense, or otherwise provide access to the Service or your keys to third parties. This includes key marketplaces, shared accounts, and services that re-expose the Service or your keys to others.
- You may build your own products and services that use model outputs for your own customers. You may not offer the Service itself, your API keys, or direct access to the models available through it as your product, for example by selling API keys or by operating a service whose main function is to give others access to those models.
- If a key may be compromised, stop using it, disable or replace it if you are able to, and tell us right away at security@larktide.com.
Supported regions
- The Service is not offered in mainland China, in any country or region subject to comprehensive U.S. sanctions or embargoes, or to persons on U.S. restricted-party lists. It is also not offered where the relevant model provider does not offer its service.
- Do not access the Service from a region where it is not offered, and do not use VPNs or other means to hide or misstate your location or identity to evade these restrictions. Ordinary use of a VPN for privacy or security is not a violation if you are located in a supported region and are otherwise eligible.
- Do not give access to the Service to anyone in a region where it is not offered or anyone who is not eligible to use it.
Accounts, invitations, and payments
- Accounts are created with an invitation code. Request access at access@larktide.com. Do not sell, trade, or publicly post invitation codes.
- Do not create automated signups, or use bots or scripts to create accounts or obtain invitation codes.
- Do not create or use multiple accounts to evade limits, restrictions, or enforcement actions. This includes purchase limits ($500 per purchase and $1,000 in purchases per account per day, UTC), spending limits, rate limits, and suspensions or terminations.
- Do not use a payment method that you are not authorized to use, and do not use the credit purchase flow to test or validate stolen, unauthorized, or unverified card details.
- Do not sell, transfer, or exchange credits between accounts, or try to obtain cash or any other value for them except through a refund described on our Refund Policy page.
Load and abuse
- Do not load test, stress test, or benchmark the Service at abusive volumes, and do not flood it with requests or otherwise interfere with its availability for others. If you need to run a high-volume test, ask us first at support@larktide.com.
- Do not access other customers' data or degrade the Service. Do not scan, probe, or test the security of the Service (including by attempting to breach it) without our written permission, which you can request at security@larktide.com.
- If you come across a vulnerability during ordinary use, do not exploit it or access or keep other people's data, and report it to security@larktide.com. Give us reasonable time to fix it before you disclose it publicly.
- Do not exploit billing, credit, or limit mechanisms to obtain service without paying for it.
5. Disclosure of AI-generated content
You are responsible for telling people when the law or a platform you publish on requires you to disclose that content is AI-generated or that they are interacting with an AI system. Examples include laws that require disclosure of automated conversational systems, labeling of synthetic or manipulated media, and disclosure of AI use in political advertising.
- Do not present AI-generated content as human-created in a way that is deceptive or violates a disclosure requirement.
- Do not remove, hide, or alter any label, watermark, or provenance information that is required by law.
6. Enforcement
We may investigate suspected violations of this Policy. We do not store prompt or output content for normal requests (see our Privacy Policy), so our decisions may be based on account and usage metadata, error responses that we may log for troubleshooting, reports we receive, and information from third parties, including model providers. We are not obliged to monitor use of the Service, and choosing not to act in a particular case does not waive our rights.
Depending on the nature, severity, and history of the violation, and the risk to others, we may take one or more of these actions:

| Reporting | We report to law enforcement, regulators, or other authorities, and cooperate with their lawful requests. |
- Immediate action. We may suspend or terminate without prior notice where we reasonably believe it is necessary to prevent harm, to protect the security of the Service or other users, to comply with law or a legal request, or because a model provider requires it. Violations of the child safety rules above will result in termination. Violations involving violent extremism or weapons of mass destruction will ordinarily result in termination.
- Notice. Where practical, we will tell you by email at your account address what we did and why, unless the law or an investigation prevents it.
- Reporting to authorities. We may report apparent violations to authorities where we believe it is appropriate or required by law. For example, we report apparent child sexual abuse material to the appropriate authorities to the extent required by law.
- Requesting review. If you believe we made a mistake, write to support@larktide.com with your account email and an explanation. We will review it in good faith, but we are not required to reverse our decision.
- Refunds and payment disputes. The refund of your remaining paid credit balance on account closure, described on our Refund Policy page, does not apply when we close an account for a violation of this Policy or the Terms. Accounts with a disputed payment are suspended until the dispute is resolved. Refunds required by law are always honored.
Our rights under this Policy are in addition to our other rights and remedies under the Terms and applicable law.
7. Reporting abuse
If you believe someone is using the Service in violation of this Policy, email support@larktide.com. To report a security vulnerability or a compromised API key, email security@larktide.com.
Helpful reports include:
- a description of what happened and why you think it violates this Policy;
- dates and times and request IDs, if you have them; and
- any links or other evidence that do not themselves contain illegal content.
Do not send us CSAM or other illegal material. If you come across child sexual abuse material, report it to your local authorities or to a recognized child-safety reporting channel. If someone is in immediate danger, contact your local emergency services. We are not an emergency service.
We review reports in good faith. We may not be able to reply to every report or tell you what action, if any, we took.
8. Changes and questions
We may update this Policy as the Service, the law, or model provider policies change. We will post the revised Policy on this page with a new "Last updated" date, and changes take effect when posted unless we state a later date. For material changes we will also, where practical, notify you by email at your account address. Changes that are needed to comply with law or to address a safety or security risk may take effect immediately. Continuing to use the Service after a change takes effect means you accept the revised Policy.
